Question 1

Is there a legal limit on how bright my neighbour’s light can be?

Accepted Answer

Light pollution laws in Victoria set no single limit for all residential lighting. Where a planning permit applies, it usually refers to the AS/NZS 4282 limits. Otherwise, councils look at whether the light amounts to a nuisance.

Question 2

Can council make my neighbour change their light?

Accepted Answer

Councils can investigate and act where they find a nuisance or a breach of a planning permit. Many cases are resolved by simple changes such as re-aiming or shielding.

Question 3

Can light be measured at my window?

Accepted Answer

Yes. Vertical illuminance at the window and the intensity of the light source can be measured on site at night with calibrated meters, and compared with AS/NZS 4282.

Question 4

Do I need a lawyer?

Accepted Answer

Not to raise a complaint with your neighbour or council, or to use mediation. For a civil nuisance claim, get legal advice.
